Overview Welcome to SnugMelt! The terms "we", "us" and "our" refer to SnugMelt, an online store operated by Lluís Arto. You can find our full contact details on our Contact Information page. SnugMelt operates this store and the website snugmelt.com, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the "Services"). SnugMelt is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them (including our Refund Policy, Shipping Policy and Privacy Policy), describe your rights and responsibilities when you use the Services. Please read them carefully.

By visiting, interacting with or using our Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Services. Nothing in these Terms limits any rights you have under the consumer protection laws that apply to you or any other rights that cannot be waived by contract. Where these Terms conflict with those rights, those rights apply.

1. Access and Account By agreeing to these Terms, you confirm that you are at least the age of majority in your state, province or country of residence. To use the Services or make a purchase, you may be asked to provide certain information, such as your email address and your billing, payment and shipping details. You confirm that all information you provide is correct, current and complete. If you create an account, you are responsible for keeping your login details secure.

2. Our Products We do our best to describe and display our products accurately, including their size, materials and what's included. Colors may look slightly different depending on your screen and device settings. If a product you receive is not as described, you're covered by our Refund Policy and by your legal rights. We may update product descriptions, discontinue products or limit quantities per customer, region or order.

3. Product Safety and Use Our chocolate fondue mug is heated by a tealight candle. For your safety, please:

• always place the mug on a stable, heat-resistant surface, such as a board or trivet, as the base becomes warm during use;
• never leave a lit candle unattended, and keep it away from children, pets and flammable materials;
• only use a standard tealight in the opening at the base, and never place the mug on a direct flame, stove, microwave or oven;
• let the mug cool completely before handling the base or cleaning it, and wash it by hand.

Please follow these instructions and any instructions included with the product.

4. Orders When you place an order, you make an offer to buy the products in your cart, and you authorize us and our payment processors to charge the total amount to your chosen payment method. Your order is accepted when we send you an order confirmation email. We may decline or cancel an order, for example if a product is unavailable, if there's an error in the price or description, or if we suspect fraud. If we cancel an order after you've been charged, we will refund you in full.

You can cancel your order free of charge before it ships, as described in our Refund Policy. Returns and refunds are governed by our Refund Policy and by your legal rights. You confirm that your purchases are for personal or household use and not for commercial resale.

5. Prices and Payment Prices are shown in your local currency where available and may change from time to time, but the price you pay is the price shown when you place your order, as confirmed in your order confirmation email. Prices include free shipping. Any applicable taxes or import duties that we collect are shown at checkout before you pay. From time to time we may run promotions, which may be subject to separate terms.

You confirm that (1) you are authorized to use the payment method you provide, (2) your payment information is true, correct and complete, and (3) you will pay all charges you incur at the prices in effect when you place your order.

6. Shipping and Delivery Delivery times shown on our website are estimates. We work hard to deliver every order on time, but delays may occasionally happen due to carriers, customs or events beyond our reasonable control, such as natural disasters, severe weather, strikes or government actions. The risk of loss or damage to your order passes to you when it is delivered to you or to a person you designate. 7. Intellectual Property The SnugMelt name, logo, website design, texts, images, graphics and videos are owned by SnugMelt or its licensors and are protected by intellectual property laws. You may use the Services only for personal, non-commercial purposes. You may not reproduce, distribute, modify or republish any material from the Services without our prior written consent. Buying a product does not give you any intellectual property rights in the product or its design. Shopify's name and logo are trademarks of Shopify. Other names and logos shown on the Services belong to their respective owners.

8. Third-Party Tools and Links The Services may include tools or links provided by third parties, such as payment providers, shipping tracking or social media. We don't control these third-party services and are not responsible for their content or practices. Please review their terms and policies before using them.

9. Relationship with Shopify SnugMelt is powered by Shopify. When you use the Services, your device communicates with Shopify's systems. However, every sale you make in our store is made directly with SnugMelt, and Shopify is not responsible for any part of it.

10. Privacy Our Privacy Policy explains how we collect, use and share your personal information. Because Shopify hosts the Services, Shopify also collects and processes certain information about your use of the Services and your transactions, including to process payments and prevent fraud. 11. Reviews, Photos and Feedback If you send us or publish reviews, photos, ideas or other content ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce and display it to operate and promote SnugMelt. We will only feature your photos or your name on our website or social media with your permission. You confirm that your Feedback is your own, is honest, does not infringe anyone's rights, and that you have disclosed any incentive you received for it. We may remove Feedback that is unlawful, offensive or that infringes these Terms.

12. Errors and Inaccuracies Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions, including in product descriptions, prices, promotions or availability. We reserve the right to correct them and to cancel affected orders. If we cancel an order you've already paid for, we will refund you in full.

13. Prohibited Uses You may only use the Services for lawful purposes. You agree not to: use the Services for any unlawful or fraudulent purpose; provide false information or impersonate another person; harass or harm others; upload viruses or malicious code; collect other users' personal information; send spam; use robots, scrapers or other automated tools to access the Services; or interfere with the security of the Services. We may suspend or end your access if you breach these Terms.

14. Agents Any software or service acting autonomously on your behalf (an "Agent") may only access or use the Services if it clearly identifies itself as an Agent in every request (including "Agent/[agent name]" in its user agent string), does not imitate human behavior or bypass CAPTCHAs or other access controls, and answers truthfully if asked whether it is automated. We may restrict or block Agents at any time.

15. Termination We may suspend or end your access to the Services if you breach these Terms. Any orders already placed will still be handled according to these Terms, our Refund Policy and the law. Sections that by their nature should continue after termination (such as Intellectual Property, Limitation of Liability and Governing Law) will continue to apply.

16. Warranties Information on our website is provided for general information. We do our best to keep it accurate and up to date, and to keep the website available and secure, but we can't guarantee that it will always be uninterrupted or error-free.

Our products come with the guarantees set out in our Refund Policy and with all warranties and guarantees that apply under the consumer protection laws of your country, which cannot be excluded. Except for those, and to the extent permitted by law, we don't give any other express or implied warranties.

17. Limitation of Liability To the extent permitted by law, SnugMelt will not be liable for any indirect, incidental, special or consequential losses, such as loss of profits, revenue or data, arising from your use of the Services or the products, and our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under product liability laws, or for any other liability that cannot be excluded or limited by law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

18. Indemnification To the extent permitted by law, you agree to compensate SnugMelt for any reasonable losses, costs or claims caused by your breach of these Terms or your misuse of the Services. This does not apply to the extent that we caused the loss.

19. Severability If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforced to the maximum extent permitted by law and the rest of these Terms will remain in full force.

20. Entire Agreement These Terms and the policies referenced in them form the entire agreement between you and us regarding the Services. If we don't enforce a right or provision of these Terms, that does not mean we waive it.

21. Assignment You may not transfer your rights or obligations under these Terms without our consent. We may transfer ours to another organization, provided this does not reduce your rights.

22. Governing Law and Disputes These Terms are governed by the laws of Spain. However, if you are a consumer, you will also benefit from any mandatory provisions of the law of the country where you live, and you may bring a claim in the courts of your country of residence. 23. Translations These Terms may be available in other languages. If there is any difference between versions, the English version prevails, unless the law requires otherwise.
